Kalexedy Learning Center Terms and Conditions
Effective Date: January 5, 2025
Welcome to Kalexedy Learning Center! These Terms and Conditions ("Terms") apply to all participants, families, guardians, and authorized caregivers involved in any program or activity offered by:

By registering for any Kalexedy program, the parent or legal guardian acknowledges that they have read, understood, and agreed to these Terms and Conditions. This agreement is binding upon the undersigned and their respective heirs, legal representatives, and assigns.
I. Registration and Attendance
- Eligibility:
- Summer Program: Open to attendees ages 8 to 14 at the time of attendance.
- Learning Center: Programs are open to attendees entering grades 3–12, unless otherwise specified. Some programs may have age or academic prerequisites.
- After School Club: Open to attendees ages 7 to 15 at the time of attendance.
- Enrollment: Registration is confirmed only after all required forms are submitted and payment is received.
- Assumption of Risk: Participation may include physical, emotional, or intellectual activities with inherent risks. By enrolling, parents acknowledge these risks and voluntarily assume them.
- Missed Sessions: Missed days cannot be rescheduled or refunded.
- Language: All instruction provided by staff is primarily conducted in English.
- Program Modifications: Kalexedy reserves the right to modify or cancel any session or class due to enrollment, staffing, or facility constraints.
- Non-Transferability: Registration is non-transferable to other children or terms.
- Force Majeure: Kalexedy is not liable for delays or cancellations caused by acts of God, public health emergencies, or other unforeseeable events
II. Fees and Payments
- Payment Due:
- Summer Programs: Full payment is due by May 15, 2025, or at registration, unless otherwise arranged.
- Learning Center: Payment is per financial agreement at enrollment.
- After School Club: Payment is per month and due by the first day of the month.
- Refund Policy:
- Summer Programs:
- Full refunds (less a $75 processing fee) are available if cancellation is made in writing before May 15, 2025.
- No refunds after May 15, 2025, unless Kalexedy cancels the program.
- Learning Center:
- Full refunds (less a $75 processing fee) are available if cancellation is made in writing within the first 30 calendar days.
- Families are expected to commit by semester (September–January, February–June). Withdrawal after 30 days forfeits all refunds; any outstanding semester fees remain due.
- Exceptions may be considered at the discretion of Kalexedy in cases of hardship or unforeseen events.
- After School Club:
- Full refunds (less a $35 processing fee) are available if cancellation is made in writing before the start of the subscription month.
- Exceptions may be considered at the discretion of Kalexedy in cases of hardship or unforeseen events.
- Late Payments: A $25 late fee may be assessed for overdue payments.
- Returned Checks: A $35 fee will be charged for returned checks or failed transactions.
- Credit Card Payments: Kalexedy reserves the right to charge processing fees for credit card payments. Payments via cash, check, or ACH do not incur fees.
- Delinquency: Kalexedy may refuse entry to attendees with unpaid account balances.
III. Code of Conduct
All participants and their families must adhere to the Kalexedy Code of Conduct:
Participants and families may NEVER:
- Engage in bullying, harassment, or intimidation.
- Use inappropriate or discriminatory language.
- Share or display inappropriate materials.
- Disrupt the learning environment.
- Contact instructors outside of the program.
- Impersonate others or misuse accounts.
Participants MUST:
- Treat peers and staff respectfully.
- Follow staff instructions.
- Dress appropriately.
- Use only approved tools, platforms, networks, and websites.
- Help maintain a cooperative and safe space.
Kalexedy reserves the right to suspend or terminate any attendee from its program, in its sole discretion.
Behavior that may lead to a suspension or termination includes, but is not limited to:
- Threatening, intimidating, or verbally abusing another child, adult, or Kalexedy Staff;
- Intentionally damaging property;
- Physically assaulting or harming another child, adult, or Kalexedy Staff;
- Sharing or displaying explicit content from a video game, television show, movie, website, or other form of media;
- Bringing a weapon or other tool with the intent to harm another child or adult;
- Being under the influence or in the possession of an illegal or mind altering substance.
Disciplinary Actions:
Kalexedy may take any of the following actions for behavioral violations:
- Verbal or written warnings
- Guardian contact for resolution
- Temporary or permanent removal from the program
Kalexedy reserves the right to suspend or expel any attendee, at its sole discretion. Parents may request a review meeting within 5 business days of disciplinary notification. Should an attendee be involuntarily discharged or expelled from the program, the family forfeits all payments.
IV. Media and Work Product Release
By enrolling an attendee, you:
- Grant permission for Kalexedy, and any individual or entity acting for or on behalf of Kalexedy, to photograph, video, or otherwise record your child’s image, voice, participation and/or work product.
- Authorize use of your child’s first name and likeness for marketing, educational, and promotional purposes.
- Acknowledge that Kalexedy retains ownership of all materials and projects created during its programs.
- Waive rights to inspect or approve the use of such materials.
- Release Kalexedy and its affiliates from all liabilities related to such use.
Opt-Out Option: To decline media release, email info@kalexedylearning.com for an opt-out form.
V. Video Surveillance
Kalexedy uses video surveillance in public and instructional spaces for safety. These recordings are not shared publicly except when required by law. Video surveillance is mandatory and not subject to opt-out.
VI. Observation and Interaction Consent
I understand that from time to time, third parties who are neither program staff nor parents of other attendees may visit Kalexedy while my child is there and observe my child, without interacting with my child and without my child being identified to such third parties. I understand that there are benefits to allowing such observations. For example, this allows members of the community, such as prospective attendees and their families, to learn about the program and tour the facility. It also allows the program to interact with prospective community partners which may provide services to the program. By my registration and participation, I give my general informed consent to allow this type of non-interactive, de-identified observation of my child.
I also understand that certain third parties may not only observe my child in a de-identified fashion at the learning center, but also interact with my child and learn information about my child, such as his/her/their name. I understand that these third parties include organizations and community partners that provide enrichment services through Kalexedy. By attending, I give my specific informed consent to allow this type of interactive, identifiable observation of my child.
VII. Health and Safety
- Emergency Medical Care: Parents authorize trained Kalexedy staff to administer First Aid/CPR and to seek emergency medical care as needed at their discretion.
- Special Needs: Parents must inform Kalexedy in writing of any allergies, disabilities, medical, or behavioral needs.
- Illness Policy: Sick children must stay home. Kalexedy reserves the right to send home any attendee displaying symptoms, as evaluated per the Family Handbook.
VIII. Liability Waiver and Indemnification
By enrolling, the parent/guardian:
- Releases Kalexedy from all liability for injuries or losses arising from participation in Kalexedy activities, unless caused by gross negligence or willful misconduct.
- Agrees to indemnify Kalexedy from any claims or actions resulting from their child’s conduct or participation.
- Assumes responsibility for risks and understands this agreement waives rights to future legal claims.
IX. Technology and Account Use
- Kalexedy may create accounts for attendees on educational platforms as required by the program.
- Unauthorized internet use, hacking, or policy circumvention is strictly prohibited.
X. Program Adjustments
Kalexedy may:
- Reassign attendees to different groups based on skill level.
- Combine or cancel sessions due to enrollment.
- Substitute instructors as needed.
XI. Discounts and Promotions
- Only one discount may be used per attendee.
- Discounts must be applied at registration.
- Vouchers are non-refundable, non-transferable, and expire as stated.
XII. Arbitration Agreement
Any disputes, excluding those related to fee collection, shall be resolved through binding arbitration in Middlesex County, MA under the American Arbitration Association rules. Each party bears their own costs unless otherwise determined. By agreeing to these Terms, you waive your right to a trial by jury.
XIII. Program Changes and Refusal of Service
Kalexedy reserves the right to:
- Cancel or reschedule programs.
- Refuse participation to individuals whose behavior is unsafe or incompatible with the learning environment.
XIV. Intellectual Property
All Kalexedy materials, content, and branding are protected intellectual property and may not be copied or distributed without written permission.
XV. Severability
If any provision is deemed unenforceable, the remainder of the agreement remains valid and enforceable.
XVI. Acknowledgment and Acceptance
By enrolling an attendee in any Kalexedy program, the parent/guardian affirms they have read, understood, and agree to these Terms and Conditions. A paper copy may be requested at info@kalexedylearning.com.
